"Personal injury" is a very general phrase that includes a number of different types of cases. The following is a list in alphabetical order of specific cases in which we concentrate our practice.
"Automobile Accidents" Any claim where a person is significantly injured or killed due to the fault of a motor vehicle operator.
"Construction Accidents" Illinois formerly had a law designed to protect workers involved in construction site activities known as "The Structural Work Act". Unfortunately, that was repealed and no longer exists. However, injured/deceased workers can still recover for construction site accidents if the fact supports such a recovery under principles of negligence. These cases are brought against entities on the job site other than the injured person's employer because claims directly against the employer are covered under workers' compensation (see below).
"Medical Malpractice" Medical negligence claims can be brought when the conduct of a member of the healing arts class (for example, doctors, hospitals, dentists, nurses, chiropractors) falls below the applicable standard of care and injury or death results.
"Nursing Home Claims" Sometimes, the level of care provided to an elderly resident by a licensed home sadly is inadequate. Residents being injured from being dropped during bed to wheel chair transfers, administration of the wrong medicine or wrong dosage of the correct medicine and infections from inattentiveness are but a few examples of the type of conduct that can lead to nursing home claims.
"Premise Liability" These are also commonly referred to as "slip and fall" cases. A land owner is not automatically liable for injury on his property but is responsible for injuries from the negligence of the owner or person in charge of the property. Dangerous conditions in grocery stores, inadequate security at malls and attractive nuisances that lure children to danger are possible examples.
"Products Liability" Unreasonably dangerous products that cause injury can give rise to a products liability cause of action. Examples of this type of litigation that have been in the news would include Phen-fen, tobacco and SUV rollover cases.
"Truck Crashes" Trucking accidents were not included with automobile accidents because typically there is much more involved. For example, tractor trailers come under the Federal Motor Carrier Safety Regulations which govern many things including the driver's hours of service, log books, truck operation and truck maintenance. "Worker's Compensation" Worker's Compensation is a statutory remedy for employees against their employers for injuries resulting from the course of their employment and as a result of the employment.
